Rules for Represtentatives of Athletics Interests

To Friends of Barry Athletics:

Barry University is a member of the National Collegiate Athletic Association (NCAA) and the Sunshine State Conference (SSC). We are responsible for ensuring that our coaches, student-athletes, faculty and staff, alumni, donors, and friends abide by NCAA and conference regulations. 

Under those rules, alumni, donors, and friends are categorized as “representatives of athletics interests” of Barry University. A “representative of Barry’s athletics interest” is thereby bound by the same rules and regulations as coaches and other athletic administrators and staff members. When violations occur, whether intentional or unintentional, Barry is responsible for these actions. 

This publication provides a brief overview of NCAA regulations. Your efforts to follow NCAA regulations are greatly appreciated – any inadvertent actions may jeopardize the eligibility of prospective or enrolled student athletes. 

All applicable situations cannot be covered in this publication. Should you have any questions whatsoever about what you can and cannot do as a “Barry University athletics representative,” please contact our compliance office. Your cooperation and support furthers the institution’s commitment to academic excellence and a competitive athletics program that complies with NCAA rules and regulations. Pursuant with state law, Barry University student-athletes can be compensated for name, image, and likeness (NIL) under the following conditions: 

  1. Compensation must be commensurate with market value and not provided in exchange for athletic performance or attendance at Barry University. 
  2. All NIL contracts must be reported to the Barry University compliance office. 
  3. Student-athletes are not permitted to miss class, department, or team related activities for opportunities related to NIL compensation. 
  4. The use of Barry University trademarks, logos and facilities are not permitted without permission from the Athletic Director. 
  5. All international student-athletes are required to follow all government rules and regulations related to employment. 
  6. Eligibility for need-based aid may be impacted by receipt of NIL compensation.

Representative of Athletics Interests or a “booster” is any individual who has: 

  • participated in or is a member of an agency or organization, including corporate entities (e.g., apparel and equipment companies), promoting the institution’s athletics program,
  • made financial contributions to the athletics department or its booster club,
  • assisted in recruiting prospective student athletes,
  • provided benefits (e.g., summer jobs) to enrolled student-athletes or their families, or
  • been involved otherwise in promoting the institution’s athletics program.

 

Once an individual becomes a “booster,” the person retains that identity indefinitely. 

Prospective Student-Athlete is a student who has started classes for the ninth grade or an individual who prior to the start of ninth grade receives any financial assistance or benefit (including benefits to relatives or friends) from the institution that is not provided to prospective students generally. 

A student remains a prospect until the individual enrolls in a full-time program of study and attends classes in any term of a four-year collegiate institution’s regular academic year (excluding summer); or participates in a regular-squad practice or competition at a four-year collegiate institution. 

Extra Benefit refers to any special arrangement provided to a student-athlete or his or her relatives or friends not expressly authorized by NCAA legislation. 

This also includes any special arrangements by an institutional employee or a booster. The benefits a student-athlete may not receive include, but are not limited to: Any involvement, directly or indirectly, in making arrangements for or giving any financial aid or other benefits to a prospect or his/her family, relatives, or friends such as gifts, awards, loans, employment, transportation, free or reduced rent or housing.

Recruiting is any solicitation of a prospect or relatives/legal guardians by an institutional staff member or by a representative of the institution’s athletics interests for the purpose of securing the prospect’s enrollment and participation in the institution’s athletics program. 

A Contact is any face-to-face encounter between a prospective student-athlete or the prospective student-athlete’s relatives or legal guardian(s) and an institutional staff member or athletics representative during which any dialogue occurs in excess of an exchange of a greeting. 

Recruiting by Representatives of Athletics Interests 
Representatives of an institution’s athletics interests are prohibited from making in-person, off-campus recruiting contacts or telephone calls with a prospective student-athlete or the prospective student-athlete’s relatives or legal guardians. On-campus contact is permitted, as are written communications. Recruiting contacts by representatives during a prospective student athlete’s official visit are confined to campus. 

Telephone Calls 
It is not permissible for a representative of athletics to make telephone calls to a prospective student-athlete. 

Observing Prospective Student-Athlete’s Contest
An athletics representative may view a prospective student-athlete’s athletics contest on his or her own initiative, subject to the understanding that the athletics representatives may not contact the prospective student-athlete on such occasions. 

Evaluation of Prospective Student-Athlete 
An athletics representative may not contact a prospective student-athlete’s coach, principal, or counselor in an attempt to evaluate the prospective student-athlete. 

Visiting Prospective Student-Athlete’s Institution 
An athletics representative may not visit a prospective student-athlete’s educational institution to pick up film/videotape or transcripts pertaining to the evaluation of the prospective student-athlete’s academic eligibility or athletics ability. 

Enrolled Student-Athletes 
If a student-athlete enrolled at another institution contacts you, do not discuss the possibility of transferring with the athlete. Immediately tell the athlete to contact a Barry University Compliance Department staff member. 

Commercial Advertisement 
It is permissible to use the name, image or likeness of an enrolled student-athlete to directly advertise, recommend, or promote sales or the use of a commercial product or service, provided the agreement complies with NCAA NIL legislation. 

Occasional Meal 
A student-athlete or the entire team in a sport may receive an occasional family home meal from a representative of the institution’s athletics interests provided the meal is in the individual’s home, on campus, or at a facility that is regularly used for home competition and may be catered. The representative of the institution’s athletics interests or an institutional staff member may provide reasonable local transportation to student-athletes to attend such meals.

Contact with Prospects
As an athletics representative, you are not precluded from continuing friendships with families of prospective or enrolled student-athletes. Contacts are permitted as long as they are not made for recruiting purposes and are not initiated by a Barry Athletics staff member.
